Terms of Service

Welcome to GameLister (“we,” “us,” “our”). GameLister is a multi-tenant marketplace and seller tools platform for games, systems, collectibles, and related goods in the United States only. By creating an account, listing items, buying, or using our websites and apps, you agree to these Terms.

1. The service

GameLister provides (a) seller inventory and storefront tools, (b) public storefronts for independent sellers, (c) buyer tools (watchlist, chat, offers, orders), and (d) card payment processing via Stripe. We are a platform facilitator — sellers offer goods; buyers purchase from sellers. We are not the seller of goods listed by third-party sellers unless we explicitly say so. Marketplace operations are limited to the United States (U.S. ship-to addresses on checkout).

2. Accounts

• You must provide accurate information and keep credentials secure.
• You must be able to form a binding contract (generally 18+ or the age of majority where you live).
• Marketplace buy/offer/chat requires a signed-in, verified account.
• Account types may include buyer, seller, or both. Listing inventory is free; marketplace selling fees apply when sales complete (see Fees).
• We may suspend or terminate accounts that violate these Terms, our Seller Policy, or applicable law.

3. Marketplace sales & payments

• Card payments are processed by Stripe. By paying or connecting a payout account, you also agree to applicable Stripe terms.
• Selling fee: GameLister charges 6.5% of successful marketplace sales on merchandise only (shipping collected for postage is not fee’d), plus $0.35 when merchandise is under $20 (see Fees). Opening a store and listing is free. Sellers offer free shipping or live Shippo rates — custom fixed shipping prices are not permitted.
• Buyer pays the listed price. The selling fee is deducted from the sale proceeds before seller payout.
• Funds are held until the buyer confirms delivery and the seller has provided valid shipment tracking. New sellers also have a first-sale payout cooldown (default 7 days). High-value orders may include additional hold days.
• Marketplace card checkout is processed by Stripe. Off-platform payments (Cash App, PayPal, Venmo, cash, crypto, gift cards, etc.) and any deals arranged outside GameLister checkout are not covered by platform payment holds, order disputes tooling, or seller payout rules, and may be blocked in messaging.
• Off-platform messaging (including optional WhatsApp Business links, SMS, email, or social DMs) is not part of GameLister’s official record. GameLister cannot help with a dispute or take into account anything that happens outside our in-app chat and order dispute tools.

4. Shipping, local pickup & tracking

Marketplace fulfillment is U.S. only. Sellers who ship sold items must enter a real carrier tracking number. Funds are not released until tracking is on file and delivery is confirmed (subject to cooldown and high-value hold rules). Sellers who offer local pickup complete the order when both parties enter dual meetup codes in GameLister (seller verifies the buyer’s code; buyer verifies the seller’s code). Pickup does not use carrier tracking. For orders of $500 or more, both parties are expected to follow our high-value evidence protocol (packing/unboxing or meetup video; security stickers recommended when shipping) described on Safety.

4A. Disputes, fraud tools & Legal Protection

• Parties should use GameLister disputes and reports first. See Safety.
• Legal Protection: Either party may download an Evidence Kit from an order page (timeline, messages, order facts, editable letter drafts for demand, court summary, or a cover letter to counsel the user chooses independently). GameLister does not pay attorney or court fees and does not recommend attorneys or law firms. We are not a law firm and do not provide legal advice.
• Evidence Kits organize platform records. You remain responsible for truthfulness of any filing. A Legal Defense Fund may be offered in the future; it is not live until announced on Safety.

5. Inventory photos & barcodes

Sellers may capture photos with a webcam or USB camera, upload image files, and look up barcodes in our shared library. Listing tools do not require paid AI credit packs. Sellers remain responsible for accurate titles, condition, pricing, and legal compliance of all listings.

6. Prohibited conduct

• Illegal goods, stolen property, fraud, or counterfeit items
• Circumventing fees, payment holds, or safety features
• Harassment, spam, scraping, or abusing rate limits / APIs
• Misrepresenting condition, authenticity, or shipping status
• Fake tracking numbers or false delivery claims

7. Disputes between buyers and sellers

You agree to communicate in good faith. GameLister may facilitate messages and ratings but is not obligated to mediate every dispute. Chargebacks, refunds, and Stripe processes may apply. We may reverse payouts or hold funds when fraud, policy violations, or payment network rules require it.

8. Intellectual property

GameLister branding, software, and site content are ours or our licensors’. Listing photos and text remain yours; you grant us a license to host, display, and promote them on the platform.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted uptime, barcode autofill accuracy, or that a sale will complete.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAMELISTER AND ITS OPERATORS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) FEES YOU PAID US IN THE 3 MONTHS BEFORE THE CLAIM OR (B) USD $50.

11. Indemnity

You will defend and indemnify GameLister against claims arising from your listings, goods, shipping, tax obligations, content, or violation of these Terms.

12. Changes

We may update these Terms. Material changes will be posted with a new “Last updated” date. Continued use after changes means you accept them.
